"starting point" begins right now. our "starting point" is in texas where a district attorney who vowed to hunt down his deputy's killer has himself become a murder victim. mike mclelland and his wife gunned down this weekend in their home southeast of dallas. this is the same county where less than two months ago mclelland's colleague mark hasse was shot and killed on his way to work. >> a manhunt is under way for the killer, possibly killers,

and the small dallas suburb certainly on edge this morning. george howell is live from kaufman, texas, and george i know investigators, they're not saying a lot yet are they in terms of any more on these, killings. >> brooke, no. they're not. and you know, as far as linking these two killings, they're not doing that either. but when you talk to people here in town, when you talk to public officials, they do make the point, they say that these men, these prosecutors worked very closely together on similar cases. many people believe the people we spoke to believe that this may have been a revenge hit. again, police are not linking the killings, they are not giving any more information as to what they've already put out there, but the unanswered questions, brooke, in this case have this community consumed with fears. >> we're going to find you. we're going to pull you out of whatever hole you're in, we're going to bring you back and let the people of kaufman county

prosecute you to the fullest extent of the law. >> reporter: a promise from kaufman county, texas, district attorney mike mclelland two months ago to the unknown killer of an assistant d.a. in his office. a promise, though, he would never see fulfilled. saturday night police found the bodies of the d.a. and his wife cynthia at their home. >> they both had been shot and we are in the process of completing the crime scene workup right now. >> reporter: an investigator says police found several shell casings inside the home from a high-powered rifle. >> it's pretty obvious it's unnerving, and it's unnerving to the law enforcement community, it's unnerving to the community at large. >> reporter: there are no suspects. and the sheriff's office has not officially said whether the mclellands' deaths are connected to the killing of kaufman county assistant d.a. who was shot outside the county courthouse in january. the sheriff says extra precautions are being taken to

protect county elected officials, as well as the public. >> there will be complete security at the courthouse tomorrow. visible security. >> reporter: mclelland said his coworkers were like a family, but they all knew their job came with risks. >> when you deal with bad people on a regular basis, you know that there's always the potential for these bad people to do something bad to you, because they've already done something bad to somebody else. and so they could always concentrate and backlash on you. >> and george howell, thank you very much. live with us this morning an attorney who handled multiple cases in kaufman county, also knew mclelland. good morning to you. if you can, just help us understand, as we mentioned you met mike mclelland on several occasions. just the mood in this smaller, texas, county, how palpable is the fear there? >> you know, the law enforcement

community here is very uncomfortable. i mean we're talking about, you know, we have a county just west of here, dallas county has got about 2 million people in it and we're standing in a county that's got about 100,000 people in the entire county. everybody knew each other here. it was a great place to practice law. everybody liked the district attorney's office. there just wasn't a lot of activity out here. the biggest shock out here this morning is why, in kaufman, texas, are we having a assistant d.a. get killed and an elected d.a. it's really sending some shockwaves through the community. >> you say you're on edge. mike mclelland had been talking reportedly by the soerked press, had been talking about carrying a handgun every minute of every day even when he was talking about a dog just for extra protection. he was also very public about his hunt for the killer in the hasse case. let's listen to what he said right there. >> anything that you people can do to accelerate getting our hands on this scum will be appreciated. >> now that first killing was

two months ago now. why do you think there hasn't been more, at least public leads in that first case? >> you know, there just hasn't been a lot of information that's been provided. i mean, you know, the killing of mark hasse, who was the assistant d.a., there was some speculation that it may not have been tied to his work at the d.a.'s office. it could have been something personal of nature. and it really didn't make a lot of headlines. i think now that the elected d.a. here has been killed and it's making national headlines hopefully we're going to get some leads and law enforcement personnel down here to find out who's responsible. i mean we've got to. i mean this is our local criminal justice system. most people who they're going to deal with it are going to dpoea with it at the county level and taking out the elected d.a. in such a small county in texas makes every elected d.a. vulnerable. and that's the mood this morning. >> let me also ask you we just saw the clip with mike mclelland referring to these killers as scum. he's this 23-year-old army veteran, tough talking guy.

what's the talk around town about that? >> yeah, he was. he was an army veteran, practiced law here for several years, 18 years before he ran for first public office. three years ago, in 2010, and beat out the incumbent district attorney three years ago and took over. he kept a lot of the same personnel out here. he kept the same policies and procedures in place, and he was very well liked. people would see him throughout the town. he was very personable. everybody knew that when he was in charge, you know, communities in kaufman would be safe. so, great guy. i mean it's a big loss for the entire north texas region. >> absolutely tragic all the way around. thank you very much. we're going to talk much more on this story. we'll talk to the kaufman county judge bruce wood. he worked with mclelland and hasse and in the next hour we're talk to the may william fortner and texas congressman ted poe. >> everyone is talking about one game and one awful moment in the final four march madness.

sophomore guard kevin ware shattering his leg. this was so awful, so gruesome, it left players and coaches on both teams in tears. we're not even going to show it to you because frankly it is just too tough to watch this morning. kevin ware did put out this instagram picture overnight. shows him in a hospital bed with louisville's trophy. they did go on to win the game. they won the midwest regional. louisville head coach rick pitino who was in tears on the court said his whole team was inspired by ware who told them, i'll be fine, just go win the game. cnn's jared greenberg is live in atlanta. i've never seen anything like this, jared. >> certainly not on the basketball court. you would expect an injury like this from football or soccer or hockey. this is the talk of the country. kevin ware's injury. he will not be available for the final four. the sophomore is providing his teammates with a level of motivation that simply cannot be measured. known for his tenacious defense his injury occurred when he gave his all attempting to contest a

shot. the aftermath left everyone in the stadium stunned. emotion between the lines, as you know, is a rare sight. especially when it has nothing to do with winning or losing. tears were everywhere as louisville felt for a fallen teammate as ware was rushed to a hospital the cardinals played inspired basketball outscoring duke by 19 in the second half earning louisville a trip to the final four this year to be played in atlanta. not far from ware's high school. a destination that louisville head coach rick pitino said is a bittersweet next step on the cardinals' mission to win a title. >> if we let up for a second, then kevin ware doesn't mean how much he means to us. i said we're going to dig in. we're going to play this game to the end. we're going to get him back home. nurse him to good health. and we're going to get him to atlanta. >> surgery to repair ware's broken leg was successful. he'll remain in the hospital until at least tomorrow. >> all right. >> the school says they are

hopeful that he will return with the team and hopefully travel to atlanta for the final four. >> that would be amazing if he makes that trip. thanks to you. >> just the presence on the court will help his team come saturday. want to talk a little bit more about this injury with cnn senior medical correspondent elizabeth cohen. and i know this was an open fracture. his right tibia. he's already undergone surgery. what did doctors have to do, elizabeth? >> the first thing you mentioned that it broke the skin, brooke, the first thing they worry about is infection. making sure to keep that site clean then they go in and do surgery, they fix it, they did this very quickly. i was talking to ordrt pedic surgeons not involved with his care and they said it looked gruesome but it's relatively easy to fix. you put a rod, steel or titanium, put a rod in that bone so he's now got a rod in his shin bone, and it works quite well. it was a two-hour surgery. and believe it or not, brooke, they told me that people on him

are standing up on crutches the next day. like today. >> no way. >> so even though it looks so horrible it really is quite fixable. >> we should all be hoping for is that he gets up and walks again. he's perfectly healthy. but there are a lot of people asking this question right now, could he possibly get back on the court sometime next season? >> you know, the orthopedist i speak to, both of whom have treated athletes with these kind of injuries, they said yes. they said they were very hopeful that he would be up and playing basketball maybe in like six months or so. they said it's really, again, relatively easy to repair these intensive physical therapy, every day for many months, but they thought in six months, let's say when the next season starts, that he would be able to play. they said they've seen it happen with other professional and college athletes. >> let's hope that's the case. that would be amazing. elizabeth cohen our thanks to you. >> thanks. >> christine romans has the rest of the top stories. a rescue mission gone tragically wrong in the alaska wilderness. a state trooper's helicopter

picked up a person stranded on a snow mobile saturday night, then the chopper went down. the wreckage was found yesterday. authorities say they didn't find any survivors. the pilot, a trooper, and the rescued snowmobiler were on board. it's not clear why that helicopter crashed. new developments in what looked like a brazen kidnapping in new york. police now think the whole thing was staged. surveillance cameras caught the apparent kidnappers on tape eventually they forced a couple into a minivan and speed off. the nypd says no one in the area has been reported missing. they think a group of friends did this as some kind of elaborate birthday prank. south korea's president promising to strike back if the north stages an attack. it comes just as the u.s. deployed two health fighters to seoul for joint military exercises. north korean leader kim jong-un ratcheted up the rhetoric of late. new york congressman peter king says kim is a diplomat unknown and shouldn't be taken lightly. >> it's not an empty threat.

i wouldn't be that concerned about the mainland u.s. right now. or even any u.s. territory. i think the real threat is to what north korea might be boxing itself into. kim jong-un is trying to establish himself. he's trying to be the tough guy. >> over the weekend, north korea declared it was a state of war with the south. power company officials say a deadly accident at a nuclear plant in arkansas did not put the public in danger. one worker was killed, three others injured, entergy, the power company, says the victims were helping move part of a generator out of the building when it fell and they insist the accident did not happen in a radiation area and the reactor was not affected. three people killed in a spectacular 95-vehicle crash along the virginia/north carolina border. 25 others taken to hospitals. this crash is described as a series, a chain of 17 separate wrecks. in one of them, the bed of a tractor trailer caught fire after it collided withix cars.

all lanes of interstate 77 have now been reopened. investigators say they believe weather was a factor. meteorologist jennifer delgado joins us now to explain. good morning. >> good morning, christine. weather was a factor especially when you have visibility down to less than a quarter mile. that's what we're seeing for some of those reports. now the area zoom in a bit more for you located roughly about eight miles north of north carolina into virginia right along mile marker six. it's in carroll county. as we zoom in for you. want to point out the ridges here. of course these are part of the blue ridge mountains. when you get interstate 11 which is basically moving through a valley area you get this fog and it sets up and some of these locations we're talking about fog can develop very quickly and dissipate very quickly as well. but sometimes it takes longer like what we saw on that car accident. as i take you over and show you our graphic, if you happen to be caught up in fog, make sure you slow down. and if you're driving, your first instinct is to turn those

bright lights on but the problem is when you turn your lights on bright that actually causes the light to reflect off the fog. so that reduces your visibility even more. and don't try to drive close and try to ride the taillights of the person ahead of you because, of course, somebody can come hit you from right from behind. talking about fog we do have an advisory in place for northern virginia as well as into maryland. this is in place until 9:00 a.m. we're seeing visibility down to half mile, even down to 1/8 mile in parts. make sure you're careful on the roadways and the same for areas down toward the south also dealing with the same advisory until about 9:00 a.m. christine you have to be careful on the road and drive slowly. >> all right, jennifer delgado, thanks. 17 separate wrecks. chain reaction, took hours, hours for tow truck drivers to pull all those cars off the road. >> i wish that was a joke or a prank. it's not. but it is april 1st. watch your back today. i'm just saying watch your back. i'm a little bit of a prankster.

[next stop financial center] welcome back, everyone. walmart shoppers in san jose, california, were left dazed and terrified this weekend when a driver crashed his car through the superstore's entrance. >> all of a sudden i see all kinds of people running and screaming towards the back of the walmart. like, what's going on? >> that crash was just the beginning. nick valencia is live from los angeles. nick, what happened here? >> just terrifying situation there in san jose. witnesses say he was driving

erratically in the parking lot before he plowed through the front entrance. he could have been going as fast as 40 miles per hour. police say he got out of the car, picked up a blunt object and used it as a weapon against customers. it was obviously a very scary situation for those people inside. >> he almost ran me over, and some guy picked my bike up hit the back of his car and he was going inside the car -- i mean inside the front door i mean -- i mean he was in interest to hurt people you know. >> now four people were hurt including one walmart employee who was hurt seriously. we also understand that customers played an instrumental role in subduing the attacker. they tied him up until police got there. we're not hearing very many details about the suspect other than he's in his 30s. so far police have not released a motive. john? >> i got to say the picture of that car in the walmart is just crazy. >> crazy. >> nick thanks so much. >> unbelievable. >> 20 minutes after the hour. that aside, it is frankly the

good morning, welcome back to "starting point." i'm christine romans minding your business today. it's a new month and a new quarter and so far stock futures point to a slightly lower open. but that's really not much of a surprise, because look at that first quarter. double digit gains last quarter. the s&p ended at a record high. today's drop comes as china takes steps to cool its red-hot

housing market. in this country, the job market is recovering. but a new study shows only a few cities have fully bounced back from the recession. "the wall street journal" says 14, just 14 of the nation's 100 biggest cities have more jobs today than they did before the recession. six of the 14 cities are in texas. thanks to a strong employment trend now in oil and gas and the fact the recession didn't hit texas as hard as other places. nationwide there are still 3 million fewer jobs than when the recession started in 2007. and it's opening day at ball parks across the country. in honor of that cnn money did a survey to see which locations charge the most for a beer and a hot dog. new york met fans pay the most for a hot dog. $6.25. in cincinnati, reds fans can get six hot dogs. the most economical of all 30 teams. as for beer the most expensive is at the washington national's ball park at $8 for 16 ounces.

bottom of the hour. welcome back to "starting point." this intense manhunt is under way in suburban dallas right now. police trying to find whoever gunned down the district attorney and his wife in their own home >> prosecutor mike mclelland and his wife, they were found shot to death saturday morning in kaufman county and what some are saying could be a revenge hit. just two months ago, you may remember the mclelland's assistant district attorney was gunned down near a courthouse as he walked to work. a lot of people on edge this morning. george howell is live in kaufman, texas. there's a lot of talk this morning about highs to this and the possible tie to the aryan brotherhood of texas.

>> when it comes to the tie, the possible tie, and we want to underscore possible tie to the aryan brotherhood, john, here's what we understand, back in december the texas dps, department of public safety, put out a bulletin warning authorities that they had credible information that the aryan brotherhood was actively targeting, would actively target law enforcement. now that question certainly came up after hasse's death. and you know, it's a question that has come up in this case. but again, want to be very clear, there's been no connection to that at this point. but you do hear people here in kaufman saying that these two mean men these prosecutors worked on cases that were very similar and they believe that these men may have been targeted so this could have been a targeted revenge hit. when you think about this, when you think about mclelland. he was very adamant. he was very determined to find hasse's killer, and it's chilling, really, to listen to what he said, the way he said

it, just after hasse's murder. i want you to listen to this. >> i hope that the people that did this are watching. because, we're very confident that we're going to find you, we're going to pull you out of whatever hole you're in, we're going to bring you back and let the people of kaufman county prosecute you to the fullest extent of the law. >> john, this was a tough-talking prosecutor who did not pull punches. you heard him say he would pull the person out of the hole that they're in, and another instance, referred to them as scum. this is a prosecutor who did not pull any punches when taking his place to the public, john. >> george, here's my question, obviously the investigation goes into full throttle, today beyond that what more happens in kaufman county? >> what we know today, the courthouse, it will open today, with heightened security.

we'll see a lot of security around the courthouse. but the district attorney's office, brooke, it will remain closed, as these investigators do their best to figure out who's behind this, to figure out a motive, and as we continue to ask questions, we hope to learn a little bit more about what investigators are looking into. >> george howell in kaufman county. we're about to talk to the judge in kaufman county. really one of the biggest differences when you look at the killing of the assistant district attorney just a little more than two months ago, it was a pretty clean hit. when you read about what happened he was in the parking lot outside of this courthouse you know so far at least publicly no major leads. then when you compare that to what happened just over the weekend with mr. mclelland and his wife. all kinds of shell casings left. dallas morning news is reporting they're hoping that some surveillance video there at the house will help them at least find the perpetrator. >> and also it is so chilling to hear mclelland talk about that first killing. chilling to hear him the tough talk also the associated press reporting that he was carrying a gun everywhere he went.

>> walking the dog. >> every day. >> just to be extra safe. and in the end, still murdered at his home over the weekend. >> we mention the judge. he is bruce wood. he is a judge in compton county, texas. worked with both men. judge, good morning. let me just begin with mike mclelland. i know you've talked to him just last week. what was your conversation like? how did he seem? >> well, we are a relatively small courthouse. we have a -- we're a small county. we're growing, but i did talk with mike several times over the last few weeks and what you saw on television with mike was very much his persona. and that was not a put-on. that was his everyday lifestyle. he was a very outgoing person. and was very dedicated to finding the killer of mark hasse. >> judge wood, you know, we've talked about this community being on edge right now. a short time ago i spoke with

former assistant fbi director tom even if tess about the threat faced right now by law enforcement personnel in that community. let's listen. >> for anybody involved in the criminal justice system all the way up as we saw in colorado, with the director of corrections, tom clement. people are out there that you deal with that hate you, and if they get an opportunity, may take your life. >> judge, now two killings in two months. you are a judge in this community. give me a sense of what the feeling is right now. >> well we are all on heightened alert. there's no question about that. we are following the directions, we've been given by law enforcement, as far as what we should be doing, what -- how we should be connecting our daily base. not only at work but certainly our personal lives, as well. and i do know that the law enforcement starting with our sheriff's department and the other texas rangers, the fbi, the atf, i mean we have a lot of

very professional groups that are helping in this investigation but saying all that. we also know that we have to be on the alert, as well. and so everybody that works in the courthouse, obviously there will be additional security today. but we all will be taking care of each other and without going into specifics obviously we will not do that but i can tell you the people that work in the courthouse, and the visitors that come to the courthouse today, and the rest of the time that we are dealing with this, and even in the future, they will certain be able to come to a secure facility and law enforcement again is making sure that happens. >> guys, i just want to ask about this group, this aryan brotherhood of texas. because i know back in december there was a bulletin basically warning of retaliations from strikes from this group specifically in the state of texas and they were apparently calling for let me quote them

mass casualties or death. what more do you know about this group as a judge in kaufman county? was this a group that you were familiar with? did you have to sign off on, on anything there at the courthouse regarding them? >> no. i'm not involved in criminal cases. >> okay. >> in the courthouse. we have other judges that take care of that. but what i know about the aryan brotherhood is really what i've heard on the news, as well as in the printed press. and i'm not involved in day-to-day investigation and will not get into that. i'm not knowledgeable of all the facets of this investigation -- of this investigation. >> understand, judge bruce wood thank you so much. we're sorry for losing these two folks in your county. >> well, thank you very much. >> coming up next hour we will hear from the mayor of kaufman, mayor william fortner and we will also speak with texas congressman ted poe. also a breaking story coming into cnn right now. christine romans has that. >> following this right now

now. our starting point this morning, kaufman county where half a dozen agencies are on the hunt this morning for the killer, possibly killers apparently bent on taking out top criminal justice officials. you have this man, district attorney mike mclelland and his wife, they were shot to death over the weekend in their home. all of this happening two months after assistant district attorney mark hasse was gunned down and brougin broad daylight. >> the small dallas suburb on edge and there seems to an strong connection between the crimes. george howell live. what are investigators saying this morning? >> reporter: no new leads in this case. investigators are not any closer, at least they're not telling us if they're any closer to narrowing down a suspect in

this case. there are a lot of questions here this morning. but when you talk to people, we've talked to some public officials here in town, they believe that mr. will mclelland might have been targeted,e also because they worked closely on similar cases. it may have been a revenge hit. now, again, investigators are not saying that, they're not linking these killings. but these unanswered questions leave the community in fear. >> we're going to find you. we'll pull you out of whatever hole you're in, and we'll bring you back and lit the people of kaufman county prosecute you to the fullest extent of the law. >> reporter: a promise from kaufman county texas district attorney mike mclelland two months a as ago, a promise he w never see fulfilled. saturday night police found the bodies of the d after the and his wife cynthia at their home. >> both have been shot.

ware's injury. it was an open fracture, so elizabeth cohen is standing by. you talked about how initially the fear was just infection. >> exactly. if you have a bone sticking out, you want to make sure that you clean that up. and so it looks like that happened. he was taken to the hospital very quickly. and had a two hour surgery very quickly. this is such a gruesome accident as we can see on the faces. such a horrible thing to watch. but the doctors i talked to said it's quite fixable. we spoke with orthopedic surgeons not of course taking care of ware, but they have done the surgery many times. and what you do is you take a steel or titanium rod down the shin bone. that allows the bone to heal. and the next day, the patient is up on crutches. but they're up. so it really is a relatively easy injury to fix if it's the injury that we think it is. >> prognosis going ahead, i'm

frankly shocked by what doctors are telling you about how quick his recovery might be. >> right. doctors we talked to said six months or so. they think he will likely be playing basketball again. and these doctors have worked on other athletes with similar injuries and they say they know professional and college athletes who went back and had fabulous careers after this same kind of injury. >> that would be wonderful. >> and i'm also wondering would he be well enough to make the trip to atlanta next week to see the game at the dome? >> could be possible because again the very next day, they try to get people up on crutches. would they want him to take those risks of getting through an airport and all that kind of stuff, maybe not. but he did say those doctors did say that they do try to get them up and walking around very quickly. and they have them have physical therapy every day. so might not want him to come to atlanta because they might want him to stick to a physical therapy schedule, but he might be up for it.

members of the bipartisan so-called gang of eight senators working on immigration reform legislation say they should reach consensus on a draft bill by the end of this week. >> mary bono mack is a former republican congresswoman from california and connie mack former republican congressman from florida. we're talking basketball. but we have to talk immigration reform now. i wanted to ask both of you the gang of eight says they will have a draft on the bill by the end of this week. but you have the two groups afl-cio reaching a deal with the u.s. chamber of commerce on a guest worker program. these two groups, explain the significance of these groups being on board. >> well, i think what it does is if they were not on board, then they would be out attacking the bill and trying to persuade members to vote against it. the fact that they're on it shows you that they will go out and support the bill. but i think they're still a long way to go. we still have hearings that need to be done. we don't want to have another situation like we had in health

care where a bill is brought and nobody has a chance to read it. i think you'll see the senate go through the process of having hearings on the bill, understand what's in it and see if we can pass something. >> you think there is a lot more ground to cover. so does your former colleague, senator rubio, who is a member of the so-called gang of eight. and after there was a sense of progress being made, he put a chill on it over the weekend. he released a statement that got a lot of attention. he said i'm encouraged by reports of an agreement between business groups and unions on the issue of guest workers. however reports that the bipartisan group of eight senators have agree order a legislative proposal are premature. what do you think is going on there? >> well, i think first of all the compromise or the consensus between the two is just the beginning. the afl-cio and the chamber and business groups, it's just the beginning of the conversation. and i hate to argue process, but -- >> i just did. >> i know. other than connie always being

right, it's critically important. there are a lot more people who care deeply about this will. and i've always said immigration is a three legged stool and you can't shore up one at the expense of the other or the whole thing will fall apart. border security is critically important to the american people. they have to know congress will actually follow through on what they say they will do. i think the gang of eight has established some sort of sense that at least they're talking to each other. >> can i ask about rubio, though? it seemed to some people like he was trying to cover his right flank with that statement. yes, he's working with the by the partisan gang of eight, but trying to placate the conservatives of his own party and also tea party groups who could be essential for his national political future. >> whether or not he's trying to placate the right, it's important to recognize that it's not done and negotiations are ongoing. no bill is final up it's signed into what you. and there really is a very long pathway between now and then. a lot of competing interests to take into account. and i hate to say it, a lot of

egos. >> i would say this, though. i mean, it's easy to point at marco and say is he doing this for political reasons. but at the same time, i think chuck schumer went out there and maybe spoke to soon. so maybe he was playing a little bit of politics trying to force the other gang of eight into something they weren't ready to degr agree with. i think it's smart to get something done, but we need to make sure that the american people and the senate and house have an opportunity to really vet what the proposal is. >> what about north korea is this totally switching gears. last couple of day, really ratcheting up from pyongyang what we've been seeing. we learned that now there are rockets facing u.s. military bases right in the pacific, fears of some sort of action from this young leader kim jong-un. we know he's fired a number of people who were on his dad's staff. maybe shrinking his staff.

welcome back to "starting point". a small texas town gripped with fear this morning as an intense manhunt gets under way for the killer or killers targeting criminal justice officials. district attorney mike mclelland and his wife were shot to death this weekend at their suburban dallas home. remember only two months ago assistant district attorney mark hasse was gunned down steps from the county courthouse. >> we talked to an attorney and friend of one of the prosecutors

killed about how this town is reacting. here s is what he told us. >> law enforcement community is very uncomfort shl. we have a county just west of here dallas county has about 2 million people in it and we're standing in a county that has about 100,000 people in the entire county. everybody knew each other here. it was a great place to practice law. everybody liked the strict attorney's office. there just wasn't a lot of activity out here. so the biggest shock out here this morning is why in kaufman, texas are we having an assistant da get killed and elected da. it's sending shockwaves through the community. >> so far police have no suspects and no motive. i want to bring in congressman ted poe who has served as prosecutor and junk in that state. good morning. >> good morning. >> let me begin with mike mclelland. you can tell us more about him? >> he was a career law

enforcement person. he served as a criminal defense lawyer, he worked in the criminal courthouse before that he served 23 years in the military. so basically a good person who believed in upholding the law. and as sdrirkt attorney, he was very well liked in kaufman county. very well respected by both kinds of the bar. prosecution and the defense. >> you were a judge and prosecutor for years. this both those jobs, you were threatened with violence. so are we doing enough to protect our law enforcement officials? >> well, you can always do more of course. judges especially those who have worked in the criminal courthouse like i did, when you hear criminal cases, the person if convicted goes to prison, but the family members and friends, associates of the individual, they don't go to prison. so you always have that constant

concern and the people getting out. but in the big scheme of things nationwide, there has really not been that many attacks on prosecutors. 13 have been killed over the last 30 years. but more prosecutors are watching out for their own safety and the safety of their families and judges, as well, because people sometimes have become more violent and don't like not only the case, but the case that the prosecutor is investigating. and in this case, it seems to me like this was a case where the d.a.'s office was investigating certain criminal gang and that's why these events may have occurred. >> so here we have congressman poe over the course of the last two months, an assistant district attorney here in kaufman county, then d.a., we were talking to the mayor a little earlier this morning and he brought up this point about who they could find to fill the role. take a listen. this is mayor fortner.

>> i believe he was doing an excellent job as district attorney. i wonder if the governor will find anyone brave enough to at that time job of district attorney because that's what i've been told the governor will appoint a new district attorney before long. >> congressman, if i can get you to react to what he said and then just also how do you fill a role where potentially he or she would have a target on his or her back. >> well, this is a small county, not very many people. really not very many attorneys. but there will be someone that the governor's office will appoint to fill the role of district attorney. my own opinion is that one of the purposes of these murders was intimidation by a group of individuals to intimidate the district attorney's office not to investigate their particular criminal activity. i do not believe that intimidation will work. there will be someone who will

step forward to continue this investigation and find the culprits who are responsible for these two homicides or really three homicides now. >> you keep referring to a group of individuals who may be involved with these crimes. there's been a lot of talk about the aryan brotherhood of texas, do you think that's a possibility or are you talking about another group in the organized crime community? >> well, i believe it is a group. it could be possibly the aryan brotherhood. the district attorney has said they operate in his portion of the state of texas. it's a prison criminal gang. when they get out, many of them continue criminal ways. the district attorney's officer was investigating this gang and they it may be they wanted to prevent that investigation. that is just one possible scenario. but i think more than one person was involved in these three

homicides now. >> just final question. if you're waking up in this small town, i know we were talking to the judge, this kind of town where your neighbors know neighbors. who do you proceed? how do you not constantly look over your shoulder? >> i'm sure that the people in kaufman county, most of them who know each other, people that come into the county, they are very concerned about maybe their safety, but also the safety of law enforcement personnel. these murders, the three murders seem to me to be specifically aimed at certain people in particular roles in law enforcement, not other people in the community. that's why now the texas rangers, fbi and law enforcement will find these culprits and bring them to justice. but people are very concerned about their own safety. >> congressman ted poe, we appreciate your time with us this morning. thank you. >> the concern is certainly understandable this morning.
